2nd hand guarantee / warranty / liability

hey gear lovers :slight_smile:

i send a mail to a german online retailer, thomann to be exact, and asked them

if I had the same coverage for their products, if I buy it second hand, with remaining warranty and held the receipt / invoice in my hand …

surprisingly the answer was N O

their argument was, when I make a purchase, I enter into a legally binding agreement of 2 parties i.e. ME and the Retailer.

once the good will be sold to a third party (i.e. userXYZ on ebay or wherever)

you can ONLY claim warranty disputes from that seller and NOT from the retailer anymore…

i didnt know that!

what are your thoughts on that?

… i know this is very germany specific, but i assume european law is pretty similar …

I sold gear with the original receipt which was under warranty, never dreaming of having to deal with 3 rd party issues afterwards , i also wrote a little sales note saying it was a private sale …bölablalbalbllöö … any lawyers around? *g

Is that specific to a retailer’s warranty and is a manufacturer’s warranty different?

In my experience, manufacturers honor their warranty no matter where the purchase was made or how often the unit was resold.

i was talking about thomann the german online retailer — who I had very very good experiences with, and I can honestly recommend these guys
