Bad Gear

I meant scott’s video above.

I’m not sure if TE has updated their terms of service since he posted the video but it’s from today. If they ever have had it in there, it’s underhanded however I see it.

I agree with that for sure, and the part of the video you’re referencing stands autonomous to the bad gear controversy. In my opinion, I guess I should say.

Yeah, I don’t see anyone angry or pissed off here. I also doubt that Bad Gear would post a video where he actually makes someone angry or uncomfortable. Doesn’t seem like his style at all…

I was originally taken aback by the price but if this narrative stays as is right now the device will become one of many devices with similar but different legal things to remember. It would be terrible to have to label each device according to what can be on camera when I’m talking vs playing or even more brackets.

Scott is free to share his opinion and I did watch it but he’s not making friends all around the table. Price only matters if it matters, anyone insensitive to price can just enjoy the box for what it is. Bad policy can potentially make you liable for much more money than the device costs to buy + lawyer fees.

Well as I stated previously I don’t know anything about international law and I won’t pretend to, but in regard to fair use, and in countries where it’s enforced, TE will have a difficult time enforcing the end user agreement in court, but only in regard to parody and fair use - otherwise it’s like any other content license, bullshit or not.

caveat emptor, I guess.

I don’t think we can expect answers with finality here, I’m not expecting you to be a lawyer and neither am I. The copyright thing is definitely outside what I think is a reasonable expectation of ownership when purchasing a stand alone device, and that’s our domain as consumers.

perfect encapsulation of this phenomenon. lots of people who need their TE hate validated so they feel like the smart people hopping on board a bandwagon with incorrect information and a deep need to be right.

I’m flipping 0.3 seconds of 1 sample from a TE133 Medieval device, which I don’t own, in this song:

0.3 seconds. Now what?

It’s a problem that will probably mysteriously disappear, it will not benefit either party to have a focused content legality war between these 2 parties. There is no situation in which this makes either of them look good so I assume that either pilz will back off, or they’ll come to an agreement behind the scenes.

To be frank, I think he (pilz) only addresses it directly to keep people from thinking he’s intentionally avoiding it. He says in the same breath that the takedown notice is shown

“every now and then this show needs some blasphemy, a little slap in the face of iconic music history milestones and one of these ‘he’s obviously trolling moments’ true bad gear fans crave at least once a year”

I think this is a highly intelligent guy, and what he’s saying is his way of addressing it, that it was trolling. That may be the last that we hear of it from him.

I would like some closure on this but I’m not expecting it, although if more information comes up then I’ll be interested to hear it.

TE hasn’t sued him yet, right? isn’t it just a youtube strike?

brazil miku though? lol

I think a takedown is more akin to a cease and desist notice, it’s a warning prior to any legal action being taken (although cease and desist normally requires the person who is using something unfairly to take down the content on their own), anything like this involving DMCA is a forced takedown so I’m not sure how that applies but I haven’t heard anything about a lawsuit.

He might just be ignorant of the facts, not that it’s any better, but his video is already published and if he pulls it then it’s gonna look bad/worse. He doesn’t seem like a bad guy but I’ve heard him talk out of his ass a number of times.

Attacking someone on youtube is different from a legal battle. Youtube’s process seems arbitrary and has no transparency and little recourse for anyone involved so I wouldn’t see that warning as connected unless it’s harassment. I don’t know all that much about it but some youtubers say it’s very simple to sabotage and grief others.

this.

I also remember the video. It was not a review.

It was published in August, the “contant removal” happened in December.

My mildly educated guess is that this is actually only about the music inside the video being an original song from Teenage Engineering people.

I wish people would direct their hate towards more apt offenders. And check their facts.

You’re indeed a man of culture.

Is there a statement from TE or a public conversation between Florian and TE? Scott said in his video that “TE took it down” but if it was an automated service they may have woken up with the same surprise as Florian.

gotta feed that meat grinder, quite the existence

I feel like if we are not able to arm ourselves with facts, than any judgements we make will make us the assholes. I don’t like the situation, but I’m not willing to commit to either side of this. I really just don’t like the situation in general.
